TERMS OF USE Last revised 3/12/2020 Welcome to Again. If you live in the European Union, these Terms of Use apply between you and : Again The terms we, us, the company or Again refer to Again. 1. Agreement to accept the Terms of Use. By creating an Again account, whether on a mobile device, mobile application or computer (together, the Service), you agree to be bound by (i) these Terms of Service, (ii) our Privacy Policy, Cookie Policy, Arbitration Procedures (if applicable to you) and Security Tips, each incorporated by reference into this Agreement, and (iii) any terms disclosed and agreed to by you if you purchase additional features, products or services offered by us on the Service (together, this Agreement). If you do not agree to all of the terms and conditions of this Agreement and refuse to be bound by them, please do not use the Service. We may change this Agreement and the Service at any time. We may do so for a variety of reasons, including to reflect changes in the law or its requirements, new features, or changes in business practices. The most current version of this Agreement will be posted in the Service section of Settings as well as on again.games, and we suggest that you review the most current version regularly. The most recent version is the one that applies. If the changes include material changes that affect your rights or obligations, we will notify you in advance of such changes by reasonable means, which may include notification through the Service or by e-mail. Use of the Service after the changes are effective will constitute acceptance of the revised Agreement. 2. Eligibility. You must be at least 18 years old to create an account on Again and use the Service. By creating an account and using the Service, you represent and warrant that: you can enter into a binding contract with Again, you are not a person prohibited from using the Service under the laws of the United States or any other applicable jurisdiction, i.e., you are not on the list of Specified Nationals established by the U.S. Treasury Department or subject to any other similar prohibition, you will comply with this Agreement and all applicable rules and regulations, and you have never been convicted of a felony or prosecutable offense (or a crime of similar severity), a crime of a sexual nature or involving violence, and are not required to register as a sex offender with any state, federal or local sex offender registry. 3. Your Account. To use Again, you may log in using your Again ID. If you do so, you authorize us to access and use certain information, including your email address. For more information about the information we collect from you and how we use it, please see our Privacy Policy. You are responsible for maintaining the confidentiality of the login credentials you use to register with Again, and you are solely responsible for all activities that occur under those credentials. If you believe that someone has gained access to your account, please contact us immediately. 4. Modification of the Service and Termination. Again strives to continually improve the Service and to bring you additional features that you may find interesting and useful. This means that we may add new product features or enhancements at any time, and we may also remove certain features. In the event that such actions do not materially affect your rights or obligations, we may not notify you before implementing them. We may even suspend the Service entirely, in which case we will notify you in advance unless extenuating circumstances, such as safety or security concerns, prevent us from doing so. You may terminate your account at any time, for any reason, by sending an email to: [email protected] 5. Purchases General. At any time, Again may offer products and services for purchase (Integrated Purchases) via iTunes, Google Play, mobile carrier, direct billing from Again or other payment platforms authorized by Again. If you choose to make an Integrated Purchase, you will be required to confirm such purchase through the applicable payment provider, and your payment method (whether your credit card or a third party account such as Google Play or iTunes) (your Payment Method) will be debited for the Integrated Purchase in the amount of the posted price for the selected Service(s) as well as any sales or other taxes that may be imposed on your payments, and you authorize Again or the third party payment account, if any, to debit you. If you purchase an auto-renewing recurring subscription through an integrated purchase, your payment method will be charged for the subscription until you cancel it. After you commit to an initial subscription period, and then after any subsequent subscription period, your subscription will automatically renew for an additional equivalent period at the price you approved at the time of purchase. Automatic Renewal - Automatic Payment by Card Subscriptions are automatically renewed until you cancel or terminate them. When you subscribe, your Payment Method will be debited monthly within 24 hours of the initial purchase date at the price you agreed to at the time of the initial subscription. Your credit card information will be stored and subsequently used for automatic card payments in accordance with this Agreement. If you wish to object to a payment that has already been made, please contact Customer Service if you have been billed directly by Again, or the third party payment account in question, such as iTunes. You may also object by contacting your bank or payment provider, who can provide you with more information about your rights and applicable time limits. You can unconditionally opt out of automatic credit card payments at any time by going to the settings on Again or the third party payment account, but note that you will still be obligated to pay any remaining amount. To change or cancel your subscription, you will need to log into your third party account (or go to your Again account settings) and follow the instructions to cancel or terminate your subscription, even if you have deleted your Again account or removed the Again app from your device. Deleting your Again account or the Again app on your device does not terminate or cancel your subscription. Again will retain all funds taken from your Payment Method until you terminate or cancel your subscription on Again or via the Third Party Account, if applicable. If you terminate or cancel your subscription, you may continue to use it until the end of the current subscription period. Your subscription will not be renewed at the end of that period. Additional terms that apply if you pay Again directly via your Payment Method. If you pay Again directly, Again may correct any billing errors made even if the payment has already been issued or received. In the event of a refund request or cancellation of a payment issued using your Payment Method, Again may close your account immediately at its sole discretion. You can change your Payment Method on Again by going to the Settings section. In the event of a payment failure, due to expiration, insufficient funds or any other reason, and if you do not change your Payment Method or terminate your subscription, you remain liable for any amount due and authorize us to continue to collect your Payment Method, when updated. This may result in a change in billing dates. In addition, you authorize us to obtain new expiration dates and credit card numbers as provided by your credit or debit card issuer. The terms of your payments depend on your Payment Method and may be determined by agreements between your bank, card issuer or other provider of your Payment Method and you. Subscribers residing in the EU or European Economic Area, in accordance with local laws, are entitled to a full refund during the 14 days following the start of their subscription, without having to specify the reason. Please note that this 14-day period begins at the time of subscription. Virtual item purchases are FINAL AND NON-REFUNDABLE. To request a refund: If you registered with your Apple ID, refunds are processed by Apple, not Again. To request a refund, go to iTunes, click on your Apple ID, select Purchase History, search for the transaction, and click Report a problem. You can also submit a request at https://getsupport.apple.com. If you use your right to withdraw (except for purchases made through your Apple ID, which is managed by Apple), we will refund you (or have Google refund you) for any payments we have received from you, promptly and within 14 days of the date we acknowledge receipt of your withdrawal request. This refund will be made using the same payment method you used for the original transaction. In all cases, you will not be charged for this refund. You may not cancel an order for digital content that is not delivered by physical means, if the processing of the order has begun with your explicit consent, and you have been informed that you will lose your right of withdrawal by proceeding with the order. This condition applies, for example, to purchases of Virtual Items. Therefore, purchases are DEFINITIVE AND NON-REFUNDABLE. Pricing. Again provides services to a diverse community of members. Our pricing structure may vary by region, length of membership, size of the bundle, recent in-app promotions and other factors. We frequently test new features and pricing to provide members with advanced functionality and payment options if they choose to use them.
